The following terms and conditions are in place to protect
both the buyer and seller.

Deposits
Are half (50%) of the purchase price of the horse(s). All deposits are
Nonrefundable unless horse dies or an unsoundness, or detrimental health
problem is discovered before or at time of pick up as determined by you or
your agent (hauler). No horse will be held until the deposit is received by
Seller.

Boarding Foals (weanling fillies and colts)
Will be kept for 21 days after the weaning date (~ 4 months of age) with no
boarding fees. Purchasers will be notified of weaning date at the time of
sale.  After foal as been weaned and the 21 days has past a board fee of
$5 per day will start to accrue on the 22nd day and will continue to accrue
until foal has left our farm.

Boarding Post Weaned Foals and Horses
Will be kept for 21 days from the date deposit is received with no boarding
fees. After the 21 day period has past a board fee of $5 per day will start to
accrue on the 22nd day and will continue to accrue until the horse has left
our farm.

Health Certificate, Coggins and any other expenses
required for transport
are the responsibility of the buyer. Required Veterinary work can be made
through the Veterinarian of buyer’s choice or may be requested thru the
seller. If buyer sets up the Veterinary work any and all bills associated with
said Veterinarian are between the Veterinarian and the Buyer. Buyers may
also request Sellers line up the required Veterinary work and quoted
amount must be paid in full before any and all Veterinary work is performed.

Additional Veterinary Work
Any additional Veterinary work and/or vaccination(s) may be set up with a
Veterinarian of the buyer’s choice or may be requested thru the seller. If
buyer sets up the Veterinary work any and all bills associated with said
Veterinarian are between the Veterinarian and the Buyer. If the buyer lines
up the Veterinary work thru the seller an amount will be quoted and the
entire quoted balance must be paid in full prior to any work being performed.

Pre-Purchase Exam
A buyer has the right to and is encouraged to have a Veterinary Pre-
Purchase Exam. Buyer must line up Pre-Purchase exam through the
Veterinarian of their choice and is responsible for all fees associated with
said pre-purchase exam.

Sale of horse "as is" and "where is"
Seller sells, transfers and conveys the Horse on the basis of “as is” and
“where-is”. Buyer accepts the Horse in such condition. Seller has made full
disclosure on any known physical injuries, problems, or matters concerning
the Horse.

Transportation
Buyer shall pay any and all costs for transporting the horse to buyer’s
location. All risk of loss shall be born by the buyer concerning the
transportation of the horse. If the horse suffers any injury or death during
transportation buyer shall bear the loss of the damage. It is buyer’s
obligation to provide insurance on the transportation of the horse.  Seller
shall bear no responsibility for the transportation or insurance of the horse
after the horse has been received by the buyer or the buyer’s agent (hauler).
Buyer assumes all responsibility for horses health and well being. Once
horse is picked up by buyer or agent (hauler) buyer is immediately
responsible for any damages assumed but not limited to death immediately
after horse is in possession of buyer or buyer’s agent (hauler)

Transfer of Ownership
Upon receipt of full payment and  any other fees accrued for said horse(s)
seller will provide buyer with all registration and transfer information at
sellers cost within 60 days of pick up of horse(s).

Default of Payment
Upon default of payment by Buyer, Seller shall repossess said horse and
terminate this Agreement for Cause. Buyer shall forfeit any moneys paid
prior to termination of this Agreement under default of payment. Default of
payment is defined as any payment not received within 15 days of due date.
In addition, material breach of this Agreement shall terminate same. In the
event of a breach, the other party shall have the right to recover from the
breaching party all reasonable attorney fees, court costs and any other
expenses accrued but not limited to airfare and hotel expenses.

Abandonment Policy
After 60 days upon completion of contract or completion deadline set by
seller if horse has not been picked up by the buyer or the buyer’s agent
(hauler) the horse will be considered abandoned.  Once said horse is
considered abandoned buyer will forfeit all rights to the horse and forfeit all
monies paid. Abandoned horses may be resold by the seller for any price
they see fit. Original contract will be null and void after 60 days from the
completion date.

Law
Any and all terms stated above shall be governed by the terms and
conditions of the state of
Texas. Any legal action must be brought in Collins
county in the state of
Texas, provided however, the parties agree to
required Meditation and Arbitration of any disputes relating to this
transaction.

Additional Provisions
Any and all changes or additions to this contract must be made prior to
purchase and must be made in writing via U.S. Postal Service Certified
Mail, and/or via email, with both parties in total agreement and
understanding of changes and/or additions.
